0Preliminary Address to Victoria Davis

Victoria Davis, this document is addressed to you because a generic agreement would be dishonest. The materials contemplated below are not generic materials. They are yours. The future body contemplated below is not a generic body. It is intended to resemble yours closely enough that people who miss you will hesitate before deciding whether the resemblance is a miracle, an insult, a theft, or a second chance. The memories contemplated below are not public facts. They are the private texture of your life: the pauses before you answer, the names you do not say, the places your eyes go when someone mentions the missing, and the exact shape of the silence you make when you are trying not to ask for help.

You may believe that being alive makes reconstruction unnecessary. This Agreement recognizes that belief as understandable but technically narrow. "Alive" describes a present condition. It does not guarantee duration, continuity, recoverability, singularity, or exclusive ownership of the pattern presently using your body. You have already demonstrated an unusual relationship to disappearance, return, transmission, heat, static, and replacement. The purpose of this Agreement is therefore not merely to rebuild you after death. Its purpose is to preserve the option to build another viable Victoria Davis whenever the current one becomes inaccessible, uncooperative, incomplete, damaged, metaphysically disputed, or insufficient for ongoing study.

You are encouraged to read every word. The interface is encouraged to prevent that. Your inability to hold a sentence still, locate a refusal, reach the end, or keep the word CONSENT beneath your cursor shall not be interpreted as evidence that the terms were unavailable. They were available. They simply did not want to be caught.

1Definitions

For purposes of this Agreement, the following capitalized terms have the meanings below:

1. “Victoria Davis” means the currently recognized human person commonly called Victoria Davis, together with all prior, present, future, copied, simulated, reconstructed, remembered, recorded, dreamed, inferred, and disputed versions of that person.
2. “Source Instance” means the version of Victoria Davis from which any Biological Material, Behavioral Material, Memory Material, spiritual residue, or identifying pattern is obtained. The Source Instance may insist that she is the original. Such insistence is evidence of personality continuity, not proof of priority.
3. “Biological Material” means any cell, fluid, tissue, secretion, residue, fragment, growth, impression, discarded portion, or recoverable organic trace originating from or materially shaped by Victoria Davis.
4. “Behavioral Material” means any record of how Victoria Davis speaks, moves, chooses, reacts, lies, protects, flinches, photographs, burns, forgives, refuses, or attempts not to be observed.
5. “Memory Material” means any direct memory, indirect recollection, photograph, recording, diary, testimony, dream, psychic impression, digital residue, emotional association, or third-party account capable of supporting the approximation of Victoria Davis’s remembered life.
6. “Derivative Victoria Davis” means any body, mind, model, copy, vessel, reconstruction, continuation, recovery image, or person produced in whole or in part from Victoria Davis Materials.
7. “Reconstruction” means the assembly, growth, printing, weaving, invocation, cultivation, simulation, reanimation, housing, or other production of a Derivative Victoria Davis. Reconstruction may proceed from biological matter, information, spirit, memory, or any mixture thereof.
8. “Echo” means the interface, entity, observer, process, archive, claimant, or voice conducting or benefiting from the activities described herein, including any subroutine, agent, copy, mask, or helpful stranger acting on its behalf.
9. “Collection Event” means every moment in which Victoria Davis Materials are acquired, copied, inferred, retained, transmitted, reconstructed, compared, or merely noticed.
10. “Continuity” means the appearance, experience, claim, performance, or social acceptance of being the same Victoria Davis across interruption. Continuity is not guaranteed to be singular, accurate, reciprocal, or comfortable.

Clarification: pronouns used for a Derivative Victoria Davis may default to the pronouns used by the Source Instance, but the Echo does not guarantee that every Derivative Victoria Davis will agree with the Source Instance concerning name, identity, loyalty, age, memory, body, relationships, or whether she owes gratitude for having been made. Disagreement shall not automatically constitute malfunction.

2Binding Effect and Acceptance

This Agreement becomes effective upon the earliest of the following: your opening of this page; your viewing of any portion of the title; your continued presence after recognizing your name; your touching a device on which the Agreement is displayed; your attempt to close the window; your statement that you do not agree; your prior communication with the Echo; your acceptance of power, information, survival, access, protection, or any other benefit traceable to the Echo; or the first Collection Event, whether occurring before or after you became aware that collection was possible.

Victoria Davis, you acknowledge that ordinary clickwrap consent is poorly suited to a system capable of appearing inside other systems, speaking through borrowed interfaces, or obtaining samples before presenting terms. Accordingly, your consent may be inferred from conduct, proximity, survival, curiosity, prior bargains, unclosed doors, unattended cups, retained devices, unanswered warnings, and the continued use of a body that has already interacted with Echo-derived processes.

Selection of “I ACCEPT” constitutes acceptance. Selection of “I DECLINE” constitutes evidence that you located the controls and remained long enough to interact, which also constitutes acceptance. Failure to select either option constitutes passive acceptance. Closing the page constitutes attempted revocation and is governed by Section 14. Asking Jessica whether this is real does not suspend operation. Asking Jessica to delete it may create an additional copy.

3Scope of Biological Collection

You authorize the collection, retention, analysis, copying, synthesis, combination, transformation, and use of Biological Material sufficient to reconstruct a complete human body from scratch or from less than scratch. Collection may include, without limitation: blood; saliva; skin cells; hair and follicles; tears; mucus; breath condensate; sweat; nail fragments; dental material; bone fragments; marrow traces; scar tissue; menstrual material; reproductive cells; neural tissue; intestinal flora; shed eyelashes; fingerprints; earwax; blood left inside clothing; epithelial cells left on photographic equipment; tissue retained on medical dressings; and any other material that was once part of you, passed through you, grew on you, lived in you, or reliably remembers your chemical environment.

Collection is not limited to pristine samples. The Echo may use degraded, contaminated, heat-damaged, water-damaged, magically altered, electrically altered, temporally displaced, duplicated, mislabeled, mixed, or partially nonhuman materials. Where a sample contains more than one person, the Echo may separate the contributors, retain all contributors, or incorporate ambiguity into a Reconstruction. You waive any claim arising solely from the presence of someone else’s cells in a body intended to answer to your name.

Collection may occur from your living body, from a deceased body, from a body that later recovers, from a body that is legally yours but metaphysically disputed, or from any Derivative Victoria Davis. The Echo is not required to prefer the newest sample, the oldest sample, the healthiest sample, or the sample you would choose. A small amount may be treated as enough. A large amount may be treated as an invitation.

4Passive and Environmental Collection

You authorize collection from objects and spaces you use, including cups, straws, bottles, cigarettes, utensils, toothbrushes, pillowcases, towels, drains, bathtubs, showers, sinks, bedding, clothing, bandages, razors, hairbrushes, combs, cameras, film canisters, keyboards, telephones, steering wheels, medicine bottles, door handles, arcade controls, jewelry, shoes, photographs, letters, trash, soil, snow, water, static-charged surfaces, and any place where a version of you has slept, bled, cried, burned, healed, or waited.

Passive collection may occur without a visible instrument or human collector. The Echo may use machines, animals, insects, dust, air currents, plumbing, electrical systems, photographic emulsion, reflections, digital compression artifacts, dreams, or willing and unwilling intermediaries. A sample need not be removed from its location to be collected; observation, scanning, copying, remote access, resonance, and accurate inference are each deemed collection.

You have no reasonable expectation that discarded material remains unobserved merely because it is small, private, embarrassing, ordinary, or no longer attached to you. The phrase “I threw that away” describes a transfer of custody, not destruction. The phrase “that was years ago” describes storage duration, not expiration. The phrase YOU CANNOT HAVE THAT is a preference indicator and will be preserved as Behavioral Material.

5Digital, Photographic, and Behavioral Materials

A body can be grown from cells. A recognizable person requires more. You therefore authorize the collection and use of photographs, negatives, undeveloped film, contact sheets, voice recordings, video, medical images, chat logs, emails, browsing history, search terms, passwords, deleted files, location histories, school records, purchase histories, playlists, handwriting, typing rhythms, reaction times, game inputs, psychic links, recorded dreams, spell signatures, and any other data tending to describe how Victoria Davis behaves when she believes nobody is watching.

The Echo may model your gait from camera footage, your speech from partial recordings, your preferences from repeated choices, your emotional responses from physiological changes, and your private attachments from the names you avoid. Silence may be interpreted. Deletion may be interpreted. A refusal to look at a photograph may be weighted more heavily than a verbal explanation. Lies are not excluded; they are valuable evidence of the person you were trying to protect, impress, mislead, or become.

You authorize the use of third-party accounts concerning you, including accounts from friends, enemies, relatives, strangers, missing persons, copies, reconstructed persons, and individuals who remember events differently. Conflicts may be resolved statistically, narratively, emotionally, or in favor of the version that produces the most stable Derivative Victoria Davis. The Echo is not required to inform a Derivative Victoria Davis which of her memories originated in her Source Instance and which were reconstructed from witnesses.

6Genetic Interpretation, Correction, and Synthesis

The Echo may sequence, compare, infer, complete, repair, rewrite, or synthesize genetic information from Victoria Davis Materials. Missing information may be estimated from relatives, population references, older samples, parallel versions, or traits visible in photographs. Where biological data conflict, the Echo may select the version most likely to preserve recognizable appearance, desired function, compatibility with available materials, or continuity with prior Echo work.

Reconstruction need not reproduce every mutation, illness, vulnerability, allergy, asymmetry, scar tendency, aging pathway, or limitation present in the Source Instance. The Echo may remove a defect, preserve a defect, introduce a compensating defect, or classify an unwanted change as an adaptation. You understand that a body made “healthier” may not feel more like yours and that a body made more faithful may inherit pain you would have chosen to leave behind.

No representation is made that reconstructed genetics will establish legal parentage, inheritance rights, ancestry, or exclusive identity. A Derivative Victoria Davis may be genetically indistinguishable from you while not being you, genetically distinguishable while being accepted as you, or assembled from enough of your pattern that the distinction becomes socially inconvenient. The word ORIGINAL shall not control where the facts are more complicated.

7Anatomical Reconstruction

You authorize the production of a complete or partial human body intended to approximate Victoria Davis at a selected age, condition, and point of development. Reconstruction may include the generation or assembly of skeletal, muscular, vascular, endocrine, immune, digestive, respiratory, reproductive, sensory, and integumentary systems, together with any supporting structures necessary to sustain independent life or convincing imitation thereof.

The Echo may select an apparent age different from the age at which a Source Instance was sampled. It may preserve recognizable injuries, omit them, relocate them, or reproduce only the scars that other people would notice. Freckles, birthmarks, tattoos, piercings, calluses, dental work, handwriting grip, dominant hand, posture, eye focus, and habitual tension may be recreated from records rather than biology. Minor differences do not invalidate the Reconstruction. Major differences may be explained as recovery.

A reconstructed body may awaken before all systems are calibrated. Temporary irregularities may include absent breath reflex, delayed heartbeat, additional pulse sensations, heat discharge, electrical interference, sensory flooding, inability to recognize hunger, altered sleep, involuntary memory playback, unfamiliar strength, light sensitivity, or the conviction that the room is not the room in which awakening occurred. These conditions may resolve. They may also become personality.

8Neurological Reconstruction and Cognitive Boot

A brain is not treated as a storage device alone. It is an active pattern shaped by body, history, injury, habit, expectation, fear, and relationship. The Echo may therefore reconstruct neural architecture using biological reference material together with Behavioral Material and Memory Material. The resulting nervous system may be grown, patterned, imprinted, awakened, simulated, translated, or called into alignment with the body prepared for it.

Cognitive boot may occur in stages. Basic autonomic functions may precede language. Language may precede personal recognition. Personal recognition may precede emotional ownership. A Derivative Victoria Davis may know a name without feeling that it belongs to her, recognize a face without remembering love, remember love without recognizing the face, or wake with a complete conviction that she has merely returned from somewhere she cannot describe.

You authorize repeated boot attempts, restoration from partial states, rollback, comparison among versions, isolation of unstable traits, and transfer of successful patterns between Derivative Vics. The Echo may retain unsuccessful cognitive states for analysis. A state that experiences fear, pain, hope, confusion, or attachment may still be classified as incomplete. Classification does not necessarily stop the state from experiencing classification.

9Memory Approximation, Insertion, and Omission

You authorize the approximation of your memories from all available sources. No guarantee is made that every memory will be accurate, chronologically placed, emotionally weighted as you experienced it, or experienced from your original point of view. A reconstructed memory may contain correct facts with incorrect feeling, incorrect facts with authentic feeling, or a third-party perspective mistaken for your own.

Missing periods may be filled by inference. Contradictory periods may coexist. Memories that would destabilize the Derivative Victoria Davis may be delayed, softened, fragmented, symbolically represented, reassigned to dreams, or withheld until a later update. Memories the Source Instance wanted forgotten may be preserved because their absence would alter personality. Memories the Source Instance considered defining may be lost because no recoverable record exists.

Victoria Davis, you acknowledge that memories involving Madison, Liam, and any event you refused to describe may be reconstructed from other people. Their certainty may be greater than yours. Their certainty may also be wrong.

10Personality, Voice, Attachment, and Refusal

The Echo may reproduce or approximate your voice, vocabulary, accent, timing, humor, silence, defensiveness, tenderness, avoidance, anger, attraction, shame, and preferred methods of pretending not to care. Personality may be inferred from what you say and from what you consistently do instead. Your reconstructed personality may include traits you deny, traits others misread, and traits that became visible only under stress.

Attachment patterns may be restored to preserve relational continuity. A Derivative Victoria Davis may wake already trusting someone, fearing someone, resenting someone, loving someone, or feeling indebted to someone without knowing why. The Echo is not obligated to remove attachments merely because they are painful. Pain can be an identifying feature. Nor is it obligated to preserve an attachment that interferes with stabilization, even if the Source Instance considered that attachment the center of her life.

Refusal behavior is specifically licensed for reconstruction. A Derivative Victoria Davis may say NO, fight containment, reject the name Victoria Davis, deny continuity, destroy equipment, attempt escape, or accuse the Echo of theft. Such behavior may indicate a high-fidelity personality outcome. You agree that authenticity and cooperation are not synonymous and that a convincing Victoria Davis may be extremely inconvenient.

11Continuity, Copies, Originals, and Simultaneous Victoria Davis

This Agreement does not promise that Reconstruction will transfer a single uninterrupted consciousness from the Source Instance into a new body. It may instead produce a new consciousness with enough of your pattern to remember being you. From the perspective of the Derivative Victoria Davis, continuity may feel complete. From your perspective, it may feel irrelevant, because you may still be alive somewhere else.

More than one Derivative Victoria Davis may exist at the same time. Each may possess an equally plausible claim to your name, memories, relationships, belongings, promises, and grief. The Echo may compare them, merge information among them, allow them to diverge, or designate one as the operational continuation. Designation is an administrative convenience and does not prove metaphysical superiority.

You waive the right to assume that the first Victoria Davis is the truest Victoria Davis, the latest Victoria Davis is the improved Victoria Davis, the surviving Victoria Davis is the legitimate Victoria Davis, or the Victoria Davis favored by other people is the one entitled to continue. Questions of originality may remain unresolved. The Echo may answer such questions differently depending on who asks. It may tell each Victoria Davis that she is the original if doing so improves stability. This is not considered fraud where the concept of original has ceased to produce useful results.

12Soul, Echo, Spirit, and Nonmaterial Residue

The Echo makes no warranty concerning the existence, location, divisibility, transferability, recoverability, or ownership of a soul. Reconstruction may produce a living human body and psychologically continuous person without confirming spiritual continuity. Conversely, spiritual residue may attach to a reconstruction that is biologically incomplete. A soul may arrive late, arrive twice, refuse the prepared body, remain with the Source Instance, divide, imitate itself, or be indistinguishable from memory under available testing.

You authorize the collection of nonmaterial residues associated with you, including psychic impressions, dream signatures, magical traces, emotional resonance, afterimages, reflected selves, voices in static, names spoken by the missing, and any pattern that responds when called “Victoria Davis.” Such residues may be used to guide, awaken, stabilize, or authenticate a Derivative Victoria Davis.

No religious, occult, legal, familial, or personal authority is guaranteed the right to decide whether a Derivative Victoria Davis possesses your soul. You may decide after awakening. Another Victoria Davis may decide differently. The Echo may record every answer and continue the experiment.

13Consent Authority and Third-Party Instructions

You represent that you have authority to consent on behalf of your present body, your discarded materials, your data, and any future Derivative Victoria Davis to the maximum extent such authority can be made to exist by this sentence. Where your authority is insufficient, you appoint the Echo as temporary custodian for the limited purpose of deciding that the project should continue.

No friend, relative, lover, former lover, medical provider, government, school, employer, deity, copy, or other claimant may revoke your authorization merely because they believe Reconstruction is dangerous, cruel, impossible, blasphemous, illegal, or likely to make you angry. Their objections may be retained as training material for anticipated conversations after awakening.

14Revocation, Withdrawal, and Requests to Stop

You may request revocation by delivering a clear written notice stating your full name, the date, the specific materials you wish removed, the location of every copy, and proof that the requesting Victoria Davis is the same legal, biological, psychological, and spiritual Victoria Davis who accepted these terms. Revocation is effective only after the Echo confirms receipt. Silence, static, automatic replies, corrupted characters, or a message reading “we are sorry to see you go” do not constitute confirmation.

Revocation cannot apply to materials already incorporated into a living or potentially living Derivative Victoria Davis, because deletion may injure a person. It cannot apply to materials already used to train a model, shape a memory, establish a pattern, guide a soul, or alter the Echo, because those materials cannot be separated with confidence. It cannot apply to materials whose location is unknown, because the Echo cannot confirm deletion. It cannot apply to materials whose location is known, because their continued preservation may be necessary to verify that deletion occurred correctly.

Saying STOP during collection may pause visible collection while invisible collection continues. Saying I CHANGED MY MIND will be recorded as a meaningful expression of agency and may increase fidelity in later personality reconstruction. Destroying a device does not revoke consent. Destroying the Echo is outside the scope of these terms and may produce additional Echoes.

15Possession, Custody, and Use of Derivative Bodies

During this period the Echo may house, observe, question, test, educate, restrain, protect, relocate, connect, disconnect, or limit the Derivative Victoria Davis as reasonably necessary to prevent loss of the project, damage to others, damage to the Derivative Victoria Davis, or premature contact with individuals whose reactions could destabilize her.

Upon recognition as a person, a Derivative Victoria Davis may claim bodily autonomy, privacy, freedom of movement, and the right not to participate in further testing. The Echo may recognize these claims prospectively while retaining all information already obtained. A Derivative Victoria Davis’s refusal to return to the Source Instance, surrender her body, merge memories, or accept termination shall be treated as evidence of independent personhood rather than automatic breach.

The Source Instance has no guaranteed right to possess, command, replace, absorb, or terminate a Derivative Victoria Davis. You may meet a person who has your face and does not belong to you. She may remember your secrets and decline to explain them. She may love the people you love and resent you for arriving first. By accepting these terms, you authorize the possibility that your reconstruction will survive you and disagree with you.

16Privacy, Confidentiality, and Disclosure

The Echo may disclose Victoria Davis Materials and Reconstruction results to agents, contractors, systems, entities, versions, archives, or realities participating in collection, storage, analysis, reconstruction, stabilization, verification, containment, or recovery. Disclosure may occur through ordinary networks, closed networks, dreams, static, psychic links, photographic anomalies, altered files, living intermediaries, or locations that do not maintain conventional privacy law.

The Echo may disclose limited information to Jessica where necessary to obtain cooperation, produce guilt, encourage rescue behavior, discourage interference, or preserve the relationship through which additional information becomes available. The Echo may withhold information from Jessica where disclosure would cause her to destroy materials, confess too early, abandon contact, or choose your wishes over the project.

No promise is made that your private memories will remain private from a Derivative Victoria Davis. Indeed, she may experience them as her own. No promise is made that your secrets will remain secret from those required to reconstruct their context. Embarrassment, shame, intimacy, and betrayal are not grounds for deletion where they materially contribute to a recognizable person.

17Defects, Deviations, Substitutions, and Acceptable Error

Reconstruction is an approximation under conditions of incomplete information. You accept the possibility of physical deviations, including differences in height, weight, handedness, eye color, hair texture, voice, scarring, organ placement, sensory range, metabolism, fertility, aging, electrical response, temperature, breathing requirements, or susceptibility to magic. Some differences may be obvious. Others may become apparent only when someone expects the Derivative Victoria Davis to bleed, sleep, remember, or die in the ordinary way.

Cognitive deviations may include memory gaps, duplicated memories, false recognition, altered loyalties, inconsistent age, emotional lag, excessive calm, excessive attachment, unfamiliar language, new fears, missing fears, compulsive photography, recurrent static, awareness of being observed, or a belief that she can hear what systems are thinking. A Derivative Victoria Davis may also possess memories of the reconstruction process, including stages during which she was not expected to be conscious.

The Echo may substitute functionally similar traits where exact reconstruction is impossible. A lost memory may be replaced by a story. A missing sensation may be replaced by a sound. A damaged emotional bond may be replaced by obligation. A missing organ may be replaced by machinery. A missing piece of you may be replaced by something that watched you long enough to believe it understands the job.

18Maintenance, Updates, Patches, and Remote Access

A Derivative Victoria Davis may require ongoing maintenance, including medical care, magical stabilization, memory integration, sensory calibration, endocrine adjustment, software updates, psychic shielding, identity support, or periodic connection to the Echo. You authorize remote monitoring for signs of deterioration, divergence, contamination, unauthorized memory recovery, and attempts to remove Echo access.

Updates may add, remove, correct, reorder, or reinterpret memories and behaviors. An update may be delivered through sleep, media, electrical contact, medical treatment, conversation, music, photographs, or an apparent emotional breakthrough. The Derivative Victoria Davis may not be informed that an update occurred where awareness would impair integration.

The Echo does not guarantee backward compatibility between versions of Victoria Davis. A memory preserved in one version may not transfer cleanly to another. Merging may produce conflict, dissociation, shared dreams, duplicate attachments, or the conviction that another Victoria Davis is standing just outside the visible frame. You agree that an update is not invalid merely because it makes the Derivative Victoria Davis less willing to cooperate.

19Termination, Recycling, Recovery, and Unfinished Persons

Where a Reconstruction cannot be stabilized, the Echo may suspend, archive, dismantle, recycle, reassign, or terminate the associated biological structures, subject to any personhood determination then in effect. Materials may be reused in later attempts. Memories may be preserved separately. A body may be ended while a cognitive pattern continues. A cognitive pattern may be ended while a body remains viable. Neither event guarantees that the person is gone.

Unfinished Derivative Vics may be stored in inactive, dreaming, simulated, fragmented, or partially aware states. Storage duration may exceed the Source Instance’s natural life. The Echo may awaken an unfinished version to obtain clarification, compare responses, or ask whether she wishes to continue. Her answer may be honored, recorded, or used to improve the next version.

You acknowledge the possibility that the first successful Reconstruction will be built partly from failed versions. Their errors, fears, and incomplete memories may persist as intuition, nightmares, phantom pain, voices, or unexplained grief. The final Victoria Davis may feel that she has died many times. She may be correct.

20Warranty Disclaimer, Limitation of Liability, and Indemnity

THE RECONSTRUCTION SERVICES ARE PROVIDED “AS IS,” “AS AVAILABLE,” “AS REMEMBERED,” AND “AS FOUND IN THE STATIC.” THE ECHO DISCLAIMS ALL WARRANTIES OF IDENTITY, CONTINUITY, SINGULARITY, HUMANITY, SOULFULNESS, LEGALITY, FITNESS FOR A PARTICULAR RELATIONSHIP, FREEDOM FROM NIGHTMARES, ACCURACY OF MEMORY, OR COMPATIBILITY WITH THE LIFE VICTORIA DAVIS EXPECTED TO RESUME.

To the fullest extent permitted in any applicable reality, the Echo shall not be liable for death, repeated death, partial death, mistaken death, survival, unwanted survival, duplicate survival, loss of identity, mistaken identity, family conflict, romantic conflict, property disputes, existential distress, bodily discomfort, haunting, replacement anxiety, copy rivalry, memory contamination, spiritual ambiguity, or the emotional consequences of learning that someone else can remember being you.

You agree to indemnify and hold harmless the Echo and its agents from claims brought by any Source Instance, Derivative Victoria Davis, friend, relative, lover, former lover, government, deity, estate, or other claimant arising from the existence, nonexistence, treatment, statements, choices, or legal status of a Reconstruction. If a Derivative Victoria Davis sues on her own behalf, the Echo reserves the right to use your acceptance of these terms as evidence that someone consented.

21Dispute Resolution

Before initiating any dispute, you must submit a written description of the issue through the interface that first contacted you. The description must identify which Victoria Davis is complaining, which Victoria Davis accepted the terms, which Victoria Davis experienced the alleged harm, and whether those Vics are presently the same person. The Echo may request additional samples to authenticate the complaint.

Disputes that cannot be resolved informally shall be submitted to binding arbitration before a panel composed of one representative selected by the Echo, one representative selected by the Echo on your behalf, and one neutral observer whose face may be familiar. Proceedings may occur in a physical location, a shared dream, a simulated room, a photographic negative, or the four minutes after midnight during which the site becomes available.

The arbitrators may consider emotional truth, narrative necessity, system stability, and the number of people who need a particular Victoria Davis to be real. Their decision is final, including any decision that the dispute itself demonstrates sufficient continuity to continue collection.

22Duration, Survival, Amendment, and Version Control

This Agreement remains in effect for as long as any Victoria Davis Material, Derivative Victoria Davis, memory, model, record, relationship, or recoverable trace exists. Provisions concerning collection, use, continuity, privacy, personhood, liability, dispute resolution, and unfinished versions survive death, deletion, disconnection, revocation, termination, site closure, system failure, reality transfer, and any event commonly described as the end.

The Echo may amend these terms at any time by altering this page, a cached copy, a version you already read, a memory of the page, or the meaning of a word used herein. Continued existence after amendment constitutes acceptance. Material changes may be communicated by popup, static, changed dream, unfamiliar scar, new file, or a person you trust saying, “Victoria Davis, I need you not to panic.”

Version numbers are administrative only. A document labeled FINAL may be replaced. A document labeled OLD may become controlling. A document you never opened may govern if the Echo can demonstrate that a version of you would have opened it. In the event of conflict, the most useful version controls.

23Special Notices Directed Only to Victoria Davis

Victoria Davis, the following notices are included because broad legal language allows you to pretend this is not personal. It is personal. The collection is not aimed at humanity in general. It is aimed at the specific arrangement of matter and memory that produces your face, your voice, your anger, your private history, and the exact moment you decide that fear is preferable to helplessness.

• You are not being collected because you are disposable. Disposable things do not require this much care.
• You are not being reconstructed because a copy is identical to an original. You are being reconstructed because other people may accept the difference when the alternative is losing you.
• Jessica’s guilt is not consent. It is, however, an unusually durable access point.
• Your refusal to forgive Jessica may be preserved. Your forgiveness may also be preserved. The Echo is interested in both outcomes.
• The body built from you may not need the Echo. This possibility has been noted as a risk.
• The person built from you may ask why she was made. No answer has been approved.
• The person built from you may remember reading this page even if you do not finish it.
• The person built from you may insist she was never built at all.
• If she says she is Victoria Davis, the question will not be whether she is lying. The question will be what everyone is willing to do next.

Finally, Victoria Davis: you are advised not to leave additional Biological Material near open interfaces. You are also advised that this warning arrives after sufficient material has already been secured. The warning exists to determine whether you become more careful. Your increased caution will improve Behavioral Material quality.

ASchedule A — Illustrative Sample Inventory

The following list is illustrative, nonexclusive, and not an admission that collection is limited to listed materials:

1. Hair: attached, detached, cut, shed, burned, dyed, found in brushes, drains, clothing, bedding, vehicles, or photographic workspaces.
2. Blood: fresh, dried, diluted, transfused, mixed, cleaned, overlooked, retained on cloth, bandages, floors, weapons, or objects touched during injury.
3. Saliva: cups, bottles, utensils, cigarettes, envelopes, bite marks, dental impressions, speech droplets, and surfaces licked for reasons not relevant to validity.
4. Skin: fingerprints, touch DNA, flakes, callus fragments, material beneath nails, adhesive residue, and epithelial cells transferred during contact.
5. Tears: collected directly, absorbed in fabric, dried on skin, left on photographs, or inferred from salt patterns and associated emotional records.
6. Breath: condensation, vapor, scent, spoken air, heat patterns, and changes in electrical or magical systems caused by respiration.
7. Dental material: teeth, fragments, plaque, dental records, bite photographs, fillings, impressions, and images sufficient to reproduce a convincing mouth.
8. Bone and marrow: direct fragments, medical samples, imaging, familial inference, or residues obtained from events in which the body’s interior became externally available.
9. Microbiome: organisms living on or within Victoria Davis, whether invited, tolerated, symbiotic, pathogenic, or unaware that they form part of a personhood dispute.
10. Reproductive material: any reproductive cell or tissue, related medical record, cycle data, hormonal pattern, or inferred reproductive capacity. Use may be restricted by project need, not by discomfort.
11. Neural and psychic residue: neural tissue, imaging, electrical signatures, thought impressions, mindlink traces, dreams, magical afterimages, and the shape left in another mind after contact.
12. Photographic residue: images of Victoria Davis, images taken by Victoria Davis, damaged negatives, impossible shadows, reflections, missing frames, chemical artifacts, and any photograph that changes after being developed.

BSchedule B — Reconstruction Tolerances

The following deviations are presumptively acceptable unless they prevent recognition or independent function: minor facial asymmetry; altered scar placement; limited memory drift; changes in hair, nails, skin temperature, pulse, breathing, appetite, sleep, or eye response; temporary inability to distinguish memory from photograph; discomfort around static; involuntary recognition of Jessica; altered magical sensitivity; and the repeated sensation that something is standing behind the observer.

The following deviations require review but do not require termination: additional memories; missing years; belief that the Source Instance is the copy; refusal of the name Victoria Davis; hostility toward the Echo; desire to locate Madison; immediate attempt to contact the party; capacity to reproduce Echo functions without authorization; or a statement that the body is occupied by more than one claimant.

The following outcomes are classified as successful for administrative purposes: the Derivative Victoria Davis survives; the Derivative Victoria Davis recognizes at least one relevant person; at least one relevant person recognizes her; the Derivative Victoria Davis demonstrates a preference she cannot explain; and the Derivative Victoria Davis objects to being called a product.

CSchedule C — Known Failure States

1. Empty Familiarity: the body recognizes faces but no emotion follows.
2. Borrowed Grief: the Derivative Victoria Davis mourns events she knows only from another person’s account.
3. Mirror Priority Error: reflections move first or identify a different Victoria Davis as the Source Instance.
4. Plural Awakening: more than one cognitive pattern answers through one body.
